1. Preamble and acceptance of binding terms
Welcome to ANAS CANADA for Immigration Inc. ("ANAS CANADA", "we", "us"). These Terms of Service (the "Terms") are a legally binding agreement that governs your access to and use of our website at www.anascanada.ca (the "Site") and all services we provide. By accessing, browsing or using the Site and its services, you acknowledge that you have read, understood and agreed to be bound by these Terms and our Privacy Policy. If you don't agree with any part of these Terms, you may not use our Site and services.
2. Intellectual property and content ownership
All content published and made available on this Site, including but not limited to images, text, logos, documents, downloadable files, software and all underlying intellectual property rights, is the exclusive property of ANAS CANADA for Immigration Inc. or its licensors. This content is protected by Canadian and international copyright, trademark and other intellectual property laws. Unauthorized reproduction, distribution or use of our content is a serious violation of these Terms and may result in legal action.
3. User contributions and licence to content
By posting, uploading or submitting any content on our Site, you affirm that you own all rights to the content or have the necessary permissions. For content you choose to publish on the Site (such as comments or reviews), you grant ANAS CANADA a perpetual, irrevocable, worldwide, non-exclusive, royalty-free licence, with the right to sublicense, to use, reproduce, modify, publish and distribute that content in any media now known or developed later. You keep all ownership rights to your content.
This licence does not apply to the documents and information you give us for your immigration file, including anything you upload to the client portal. That information is confidential. We use it only to provide the services you have retained us for, as described in our Privacy Policy and as the CICC Code of Professional Conduct requires.
4. Age restrictions and legal capacity
Our services are intended only for people who are 18 or older and have the legal capacity to enter into a binding contract. By using the Site, you confirm that you are at least 18 years old. We may terminate your account and access to our services immediately if we learn that you are a minor or are not legally able to enter into this agreement.
5. Acceptable use policy
As a user, you agree to a strict acceptable use policy. You agree not to:
- harass, threaten or engage in any form of abusive conduct towards other users or our staff;
- violate any applicable local, provincial, federal or international laws or regulations;
- infringe the intellectual property or legal rights of ANAS CANADA or any third party;
- engage in any fraudulent activity, including impersonation or providing false information;
- transmit or upload any malware, viruses or other malicious code;
- use any automated means, including bots, scrapers or scripts, to access, copy or monitor any part of our Site without our express written consent;
- attempt to gain unauthorized access to our systems, user accounts or data.
We may suspend or permanently terminate your access to the Site and pursue all available legal remedies if we determine, at our sole discretion, that you have violated this policy.
6. User accounts and security
If you have an account, such as a client portal account, you are solely responsible for keeping your login credentials confidential and secure. You agree to tell us immediately about any unauthorized use of your account. You are also responsible for making sure that all personal and immigration-related information you give us is true, accurate and complete. We may suspend or terminate any account if the information is found to be fraudulent or misleading.
7. Sale of services and disclaimer of warranties
All services offered on our Site, including consultations and application reviews, are provided "as is" and "as available". While we strive to describe them accurately, we make no representations or warranties of any kind, express or implied, about the services. You acknowledge that you buy our services based on your own informed decision and assume all associated risks.
No guarantee of outcome: You understand and agree that the services provided by our RCIC are for informational and advisory purposes. We do not and cannot guarantee a successful outcome for any immigration application, because the final decision rests only with the relevant government authorities. This is a fundamental term of our service.
Pricing and payments: Prices for all services are in Canadian dollars (CAD) and may change without prior notice. Applicable taxes are shown before you pay. We accept the payment methods displayed on our Site and may cancel any transaction if we suspect fraud or a violation of these Terms.
Online consultations: You are responsible for your internet connection, your device and the place you join from, and for your conduct and that of anyone attending with you. We are not liable if a consultation can't be held or completed because of a problem on your side; in that case the RCIC may end the meeting and the fee paid is forfeited, as set out in section 6 of our booking policy.
8. Subscriptions and recurring services
For any subscription-based service, your subscription renews automatically at the end of each billing cycle unless you cancel it. You can manage your subscription settings or cancel at any time through your account. We will notify you before each renewal to remind you of the upcoming charge.
9. Termination
We may terminate or suspend your account and access to our services at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. Ending a consultation agreement or service agreement is governed by the terms of that agreement.
10. Limitation of liability and indemnification
Limitation of liability: ANAS CANADA for Immigration Inc., its RCIC, employees and affiliates are not liable for any direct, indirect, incidental, consequential, punitive or special damages, including but not limited to loss of data, loss of profits or loss of opportunity, arising out of your use of the Site or our services. Our total aggregate liability to you for any and all claims will not exceed the amount you have paid us for the services in question.
Indemnification: You agree to indemnify, defend and hold harmless ANAS CANADA, its RCIC, employees and affiliates from any and all claims, liabilities, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your improper use of our services, or your violation of any laws or third-party rights.
11. Force majeure
ANAS CANADA is not liable for any failure or delay in performance under this agreement caused by natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities or labour.
12. Governing law, dispute resolution and jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict of law principles. Any dispute arising from these Terms will first be addressed through good-faith negotiation. If it can't be resolved, you agree to submit to the exclusive jurisdiction of the courts of Alberta, Canada.
These Terms don't affect your right to file a complaint with the College of Immigration and Citizenship Consultants (CICC). See our communication policy.
13. Severability and waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision unless we acknowledge and agree to it in writing.
14. Entire agreement
These Terms of Service, together with our Privacy Policy and Booking Policy, are the entire agreement between you and ANAS CANADA about your use of the Site, and replace all prior communications, representations or agreements on that subject, whether oral or written. Professional services are also governed by the consultation agreement or service agreement you sign with us. If there is a conflict, that signed agreement applies to the services it covers.
